Mexico - New Telecommunications and Broadcasting Law

Further to Alphabet's newsletter issued on 2nd July 2025, the Mexico Government published the Decree issuing the Telecommunications and Broadcasting Law, and repealing the Federal Law on Telecommunications and Broadcasting on 16th July 2025. The Decree came into effect the next day from its publication on the Federal Official Gazette.

Keynotes are as below:

1.    On the day following the date on which the Plenary Session of Telecommunications Regulatory Commission is formed, the Federal Telecommunications Agency (IFT) shall be dissolved and its Commissioners shall conclude their functions. (There is no certain date for the appointment of the new commissioners, and until that day the IFT should continue operating.)

2.    Matters and proceedings that are being processed at the IFT will continue to be handled by the Telecommunications Regulatory Commission or the National Antimonopoly Commission, as appropriate, in terms of the legislation applicable at the time of their initiation.

3.    Upon the formation of the Plenary Session of the Telecommunications Regulatory Commission, all procedures and proceedings arising from the provisions of this Decree and other applicable regulations are suspended for a period of fifteen business days. The applications of IFT approvals will be subject to a five-business-day suspension.

4.    The Telecommunications Regulatory Commission, within one hundred and eighty calendar days from the entry into force of this Decree, must issue a bidding plan for radio spectrum frequency bands for the provision of mobile wireless access service.

5.    Until the regulations, general provisions, guidelines, and other legal instruments established in this Law are issued, those currently in force shall continue to apply as long as they do not contravene this Decree.
